• प्लेटफॉर्म का उपयोग इन उपयोग की शर्तों और गोपनीयता नीति की स्वीकृति का अर्थ है।

• TutLive प्लेटफॉर्म सेवाएं कम से कम 13 वर्ष की आयु के उपयोगकर्ताओं के लिए उपलब्ध हैं।

• यदि आप 13 वर्ष से कम आयु के हैं, तो आपको TutLive का उपयोग करने की अनुमति नहीं है।

• 13-17 वर्ष की आयु के उपयोगकर्ताओं को अपने माता-पिता/अभिभावकों को प्लेटफ़ॉर्म के उपयोग के बारे में सूचित करना चाहिए।

• पंजीकरण के लिए सच्चे व्यक्तिगत डेटा और सक्रिय ईमेल पते की आवश्यकता होती है।

• प्रत्येक उपयोगकर्ता केवल एक खाता रख सकता है - एकाधिक पंजीकरण प्रतिबंधित हैं।

• खाता हस्तांतरणीय नहीं है - इसे स्थानांतरित, उधार या दूसरों के साथ साझा नहीं किया जा सकता।

• उपयोगकर्ता लॉगिन डेटा की गोपनीयता बनाए रखने और अनधिकृत पहुंच की तुरंत सूचना देने का वचन देता है।

• प्लेटफ़ॉर्म को व्यावसायिक, प्रतिस्पर्धी या इसके शैक्षिक उद्देश्य के विपरीत उद्देश्यों के लिए उपयोग करना प्रतिबंधित है।

• 🤖 महत्वपूर्ण: TutLive एक कृत्रिम बुद्धिमत्ता आधारित शैक्षिक प्रणाली है। AI के उत्तरों में त्रुटियां, अशुद्धियां या अधूरी जानकारी हो सकती है।

• ⚠️ बहिष्करण: प्लेटफॉर्म चिकित्सा, कानूनी, वित्तीय या मनोवैज्ञानिक सलाह प्रदान नहीं करता।

• उपयोगकर्ता कोई भी निर्णय लेने से पहले विश्वसनीय स्रोतों से प्राप्त जानकारी को सत्यापित करने के लिए प्रतिबद्ध है।

• 🛡️ जिम्मेदारी की सीमाएं:

• • AI त्रुटियां: जिम्मेदारी अधिकतम मासिक सदस्यता शुल्क तक सीमित

• • गलत जानकारी: उपयोगकर्ता सामग्री को सत्यापित करने के लिए बाध्य

• • बाहरी सिस्टम: कानून द्वारा अनुमतित सीमा में जिम्मेदारी से बाहर

• Available plans: Starter (39 PLN), Premium (149 PLN), Pro (229 PLN).

• Payments processed by Stripe - secure and PCI DSS compliant.

• Subscriptions renew automatically - can be cancelled at any time in account settings.

• Refunds possible within 14 days of purchase without giving a reason (in accordance with consumer law).

• IMPORTANT - Loss of right of withdrawal: First use of AI functions (asking a question, generating materials, starting a session) occurs with your express consent expressed in the system and means starting the provision of services, which results in the loss of the right of withdrawal from the contract in accordance with art. 38 sec. 1 of the Consumer Rights Act.

• In case of payment problems, the subscription is suspended after 7 days - data remains safe for 30 days.

• Prices may change with 30 days' notice - existing subscriptions retain the price until renewal.

• 🤖 STARTING AI SERVICES:

• First use of any AI function on the platform (asking a question, generating materials, starting tutoring session) requires your express consent expressed by clicking the acceptance button in the system.

• ⚖️ LEGAL CONSEQUENCES:

• In accordance with art. 38 sec. 1 of the Consumer Rights Act, starting the provision of AI services with your express consent results in immediate loss of the right of withdrawal from the contract.

• 🛡️ CONSENT PROCEDURE:

• • Before first AI use you will see a message with information about loss of right of withdrawal

• • You must consciously click 'I agree' to continue

• • Your consent will be saved in the system with exact date and time

• • We also save technical data confirming the display of the message

• 📋 CONSENT DOCUMENTATION:

• System automatically documents:

• • Fact of displaying consent modal (date, time, IP address, browser)

• • Screen and browser window resolution (proof of visual accessibility)

• • Clicking accept or cancel button

• • Complete technical data of user session

• This information serves legal protection of both parties and is stored in accordance with legal requirements.

• All rights to the TutLive platform, including code, algorithms, interface, logo and content belong to the Service Provider.

• The user receives a limited, non-exclusive license to use the platform exclusively for educational purposes.

• PROHIBITED:

• • Copying, modifying or reverse engineering platform code

• • Automatic content downloading (web scraping, bots)

• • Using AI content to train competing systems

• • Creating derivative or competitive services

• The user retains rights to their own questions and notes. Interaction analysis may be used to improve AI algorithms exclusively in anonymous and aggregated manner (legal basis: legitimate interest - art. 6 sec. 1 lit. f GDPR).

• ⚖️ LIABILITY LIMITATIONS IN ACCORDANCE WITH POLISH LAW:

• • For AI errors: liability limited to the amount of monthly subscription fee

• • For content errors: exclusively when resulting from our gross negligence

• • For technical interruptions: refund of proportional fee for the period of unavailability

• • MAXIMUM liability: amount of 12-month subscription fee

• WE EXCLUDE LIABILITY (to the extent permitted by law) for:

• • Indirect, consequential, moral damages, lost profits or future profits

• • Problems resulting from internet interruptions, user hardware failures, operating system errors

• • Life, educational, professional decisions made solely based on platform information

• • Actions of third parties, unauthorized access, hacker attacks on user account

• • Losses resulting from not verifying information obtained from AI

• Platform is provided 'as is' - we strive for 99% monthly availability, but do not guarantee no technical interruptions.

• User undertakes to regularly back up important educational materials.

• In case of disputes, amicable resolution takes priority - please contact: support@tutlive.com.

• ⚖️ CONSUMERS: All disputes with consumers are resolved exclusively by competent general courts.

• ENTREPRENEURS: Disputes with entrepreneurs may be resolved by the Arbitration Court at the National Chamber of Commerce in Warsaw (with mutual consent).

• Applicable law: Polish law. Language of proceedings: Polish.

• Mediation before arbitration: in case of disputes worth over 10,000 PLN, parties undertake to attempt mediation before initiating arbitration proceedings.

• • हम अनुशंसा करते हैं कि आप अपने माता-पिता/अभिभावकों को प्लेटफ़ॉर्म के उपयोग के बारे में सूचित करें

• • आपके माता-पिता/अभिभावक आपके खाते की जानकारी तक पहुंच का अनुरोध कर सकते हैं

• • आप ऑनलाइन सेवाओं के संबंध में अपने स्थानीय कानूनों का पालन करने के लिए जिम्मेदार हैं

• माता-पिता/अभिभावक का उपयोग: यदि आप माता-पिता या कानूनी अभिभावक हैं:

• • आप एक खाता बना सकते हैं और अपने बच्चे को अपनी देखरेख में इसका उपयोग करने की अनुमति दे सकते हैं

• • आप अपने खाते पर सभी गतिविधियों के लिए जिम्मेदार हैं

• • आप AI ट्यूशन सेवाओं के उचित उपयोग को सुनिश्चित करने के लिए जिम्मेदार हैं

• • आप अपने खाते के माध्यम से गोपनीयता सेटिंग्स और डेटा हटाने का प्रबंधन कर सकते हैं

• ⚠️ महत्वपूर्ण: माता-पिता/अभिभावकों को प्लेटफ़ॉर्म पर बच्चों की गतिविधि की देखरेख करनी चाहिए और आयु-उपयुक्त उपयोग सुनिश्चित करना चाहिए।

• हम जानबूझकर 13 वर्ष से कम आयु के बच्चों से व्यक्तिगत जानकारी एकत्र नहीं करते हैं। यदि हमें पता चलता है कि कोई उपयोगकर्ता 13 वर्ष से कम आयु का है, तो हम तुरंत उनका खाता हटा देंगे।

• Account may be suspended/deleted in case of:

• • Violation of Terms of Service or Privacy Policy

• • Attempts of break-ins, attacks on infrastructure or other harmful activities

• • Using platforms for purposes inconsistent with their purpose

• • Non-payment of dues for a period longer than 30 days

• Before account deletion, the User will be notified 7 days in advance (with possibility of appeal).

• Educational data can be exported for 30 days after account suspension.

• After account deletion, data is permanently deleted immediately, maximum within 30 days (except data required by law, which we store in accordance with privacy policy).
