Gebruiksvoorwaarden

• De eigenaar van het TutLive platform is MEETZ SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ gevestigd in Poznań (ul. Juliusza Słowackiego 55/1, 60-521 Poznań), geregistreerd in het bedrijvenregister KRS onder nummer 0001051530.

• Het platform biedt educatieve diensten met behulp van kunstmatige intelligentie, 24/7 beschikbaar voor studenten van alle niveaus.

• Het gebruik van het platform betekent acceptatie van deze Gebruiksvoorwaarden en het Privacybeleid.

• De diensten van het TutLive platform zijn beschikbaar voor gebruikers die minimaal 13 jaar oud zijn.

• Als u jonger bent dan 13 jaar, mag u TutLive NIET gebruiken.

• Gebruikers tussen 13-17 jaar moeten hun ouders/voogden informeren over hun gebruik van het platform.

• Registratie vereist het verstrekken van juiste persoonlijke gegevens en een actief e-mailadres.

• Elke gebruiker kan slechts één account bezitten - meerdere registraties zijn verboden.

• Het account is niet overdraagbaar - het kan niet worden overgedragen, uitgeleend of gedeeld met anderen.

• De gebruiker verbindt zich ertoe de vertrouwelijkheid van inloggegevens te bewaren en onmiddellijk melding te maken van ongeautoriseerde toegang.

• Het is verboden het platform te gebruiken voor commerciële, concurrerende of doeleinden die niet overeenkomen met het educatieve doel.

• 🤖 BELANGRIJK: TutLive is een op kunstmatige intelligentie gebaseerd educatief systeem. AI-antwoorden kunnen fouten, onnauwkeurigheden of onvolledige informatie bevatten.

• ⚠️ UITSLUITINGEN: Het platform biedt GEEN medisch, juridisch, financieel of psychologisch advies.

• De gebruiker verbindt zich ertoe informatie van betrouwbare bronnen te verifiëren voordat beslissingen worden genomen.

• 🛡️ AANSPRAKELIJKHEIDSBEPERKINGEN:

• • AI-fouten: aansprakelijkheid beperkt tot maximaal één maandelijkse abonnementskosten

• • Onnauwkeurige informatie: gebruiker verplicht content te verifiëren

• • Externe systemen: aansprakelijkheid uitgesloten binnen wettelijk toegestane grenzen

• Available plans: Starter (39 PLN), Premium (149 PLN), Pro (229 PLN).

• Payments processed by Stripe - secure and PCI DSS compliant.

• Subscriptions renew automatically - can be cancelled at any time in account settings.

• Refunds possible within 14 days of purchase without giving a reason (in accordance with consumer law).

• IMPORTANT - Loss of right of withdrawal: First use of AI functions (asking a question, generating materials, starting a session) occurs with your express consent expressed in the system and means starting the provision of services, which results in the loss of the right of withdrawal from the contract in accordance with art. 38 sec. 1 of the Consumer Rights Act.

• In case of payment problems, the subscription is suspended after 7 days - data remains safe for 30 days.

• Prices may change with 30 days' notice - existing subscriptions retain the price until renewal.

• 🤖 STARTING AI SERVICES:

• First use of any AI function on the platform (asking a question, generating materials, starting tutoring session) requires your express consent expressed by clicking the acceptance button in the system.

• ⚖️ LEGAL CONSEQUENCES:

• In accordance with art. 38 sec. 1 of the Consumer Rights Act, starting the provision of AI services with your express consent results in immediate loss of the right of withdrawal from the contract.

• 🛡️ CONSENT PROCEDURE:

• • Before first AI use you will see a message with information about loss of right of withdrawal

• • You must consciously click 'I agree' to continue

• • Your consent will be saved in the system with exact date and time

• • We also save technical data confirming the display of the message

• 📋 CONSENT DOCUMENTATION:

• System automatically documents:

• • Fact of displaying consent modal (date, time, IP address, browser)

• • Screen and browser window resolution (proof of visual accessibility)

• • Clicking accept or cancel button

• • Complete technical data of user session

• This information serves legal protection of both parties and is stored in accordance with legal requirements.

• All rights to the TutLive platform, including code, algorithms, interface, logo and content belong to the Service Provider.

• The user receives a limited, non-exclusive license to use the platform exclusively for educational purposes.

• PROHIBITED:

• • Copying, modifying or reverse engineering platform code

• • Automatic content downloading (web scraping, bots)

• • Using AI content to train competing systems

• • Creating derivative or competitive services

• The user retains rights to their own questions and notes. Interaction analysis may be used to improve AI algorithms exclusively in anonymous and aggregated manner (legal basis: legitimate interest - art. 6 sec. 1 lit. f GDPR).

• ⚖️ LIABILITY LIMITATIONS IN ACCORDANCE WITH POLISH LAW:

• • For AI errors: liability limited to the amount of monthly subscription fee

• • For content errors: exclusively when resulting from our gross negligence

• • For technical interruptions: refund of proportional fee for the period of unavailability

• • MAXIMUM liability: amount of 12-month subscription fee

• WE EXCLUDE LIABILITY (to the extent permitted by law) for:

• • Indirect, consequential, moral damages, lost profits or future profits

• • Problems resulting from internet interruptions, user hardware failures, operating system errors

• • Life, educational, professional decisions made solely based on platform information

• • Actions of third parties, unauthorized access, hacker attacks on user account

• • Losses resulting from not verifying information obtained from AI

• Platform is provided 'as is' - we strive for 99% monthly availability, but do not guarantee no technical interruptions.

• User undertakes to regularly back up important educational materials.

• In case of disputes, amicable resolution takes priority - please contact: support@tutlive.com.

• ⚖️ CONSUMERS: All disputes with consumers are resolved exclusively by competent general courts.

• ENTREPRENEURS: Disputes with entrepreneurs may be resolved by the Arbitration Court at the National Chamber of Commerce in Warsaw (with mutual consent).

• Applicable law: Polish law. Language of proceedings: Polish.

• Mediation before arbitration: in case of disputes worth over 10,000 PLN, parties undertake to attempt mediation before initiating arbitration proceedings.

• MINIMUMLEEFTIJD: U moet minimaal 13 jaar oud zijn om een account aan te maken en TutLive te gebruiken.

• Als u jonger bent dan 13 jaar, mag u TutLive NIET gebruiken.

• GEBRUIKERS TUSSEN 13-17 JAAR: Als u tussen 13-17 jaar oud bent:

• • U mag uw eigen account aanmaken en gebruiken

• • We raden aan uw ouders/voogden te informeren over uw gebruik van het platform

• • Uw ouders/voogden kunnen toegang tot uw accountinformatie aanvragen

• • U bent verantwoordelijk voor het naleven van uw lokale wetgeving met betrekking tot online diensten

• GEBRUIK DOOR OUDERS/VOOGDEN: Als u ouder of wettelijke voogd bent:

• • U mag een account aanmaken en uw kind dit onder uw toezicht laten gebruiken

• • U bent verantwoordelijk voor alle activiteit op uw account

• • U bent verantwoordelijk voor het waarborgen van passend gebruik van AI-bijlesdiensten

• • U kunt privacy-instellingen en gegevensverwijdering beheren via uw account

• ⚠️ BELANGRIJK: Ouders/voogden moeten de activiteit van kinderen op het platform controleren en zorgen voor leeftijdsgeschikt gebruik.

• We verzamelen niet bewust persoonlijke informatie van kinderen onder 13 jaar. Als we ontdekken dat een gebruiker jonger is dan 13 jaar, verwijderen we hun account onmiddellijk.

• Account may be suspended/deleted in case of:

• • Violation of Terms of Service or Privacy Policy

• • Attempts of break-ins, attacks on infrastructure or other harmful activities

• • Using platforms for purposes inconsistent with their purpose

• • Non-payment of dues for a period longer than 30 days

• Before account deletion, the User will be notified 7 days in advance (with possibility of appeal).

• Educational data can be exported for 30 days after account suspension.

• After account deletion, data is permanently deleted immediately, maximum within 30 days (except data required by law, which we store in accordance with privacy policy).
